7/1/09 REQUIREMENTS CHANGES

Dear Customer,

We are following up on our most recent letter sent regarding new State of Maryland law now requiring a Third Party Inspector to be involved with your annual elevator inspections. We would like to follow up with some additional information and clarifications.

It is your choice whether to hire a QEI Inspector that witnesses the annual test or verifies that we have completed the test. Delaware Elevator has been performing your annual test as a part of our Elevator Maintenance Agreement. With now having to involve a QEI Inspector, you have a choice of an Inspector who will verify or witness the test. We have listed the process for each situation.

VERIFY

Delaware Elevator will perform annual safety test and leave appropriate paperwork in the elevator machine room. QEI Inspector will verify that paperwork is filled out, test tags are on, and that there are no safety violations. QEI will submit report to the State of Maryland and to the Owner. Please forward a copy to our office as well. If there are no safety issues, the State of Maryland will provide a certificate to the Owner. Please fax or contact us with the expiration date of your updated certificate.

WITNESS

Have QEI Inspector contact our office to schedule inspection. Inspections will be scheduled upon our availability. Delaware Elevator will provide the first hour with the Inspector at no charge, however we will charge after that time at our regular billing rates. Also, if we have already completed the annual safety test and you contact us to schedule with a QEI to witness our performing the test again, there will be a charge. The Owner will be responsible for advising tenants/occupants that their elevator will be out of service for approximately 2 hours per elevator on the scheduled day. Elevator will be kept out of service during this inspection period. If safety orders are written, Owner should provide a copy to our office. If Delaware Elevator needs to return to the job with QEI Inspector to verify that the orders are complete, there could be additional charges. QEI will submit paperwork to the State. Certificate will be issued by the State of Maryland and mailed to the Owner. Please fax us a copy.

SAFETY ORDERS

If your QEI Inspector writes up any safety orders on his report, please fax them to our office. We will also advise you as to which need to be addressed by the Owner. Any safety issues which can be addressed while the Technician is on site will be completed then. Any billable parts required under $300.00 will be completed at that point and an invoice will be sent to you. You will be sent a proposal for approval of any parts over this amount. Please sign and return proposals as soon as possible.
